Commissioner Meeting Minutes - July 8, 2008

PROCEEDINGS OF THE MURRAY COUNTY BOARD OF COMMISSIONERS
MURRAY COUNTY GOVERNMENT CENTER – SLAYTON, MINNESOTA
JULY 8, 2008 – 8:00 a.m.

Pursuant to notice, the Murray County Board of Commissioners convened with the following members present:  Commissioners John Giese, Gerald Magnus, Robert Moline, William J. Sauer and Kevin Vickerman.  Also present Heidi Winter, Auditor-Treasurer and Paul Malone, County Attorney.

The meeting opened by reciting the Pledge of Allegiance to the Flag.

Ronda Radke introduced new staff members Diane Slotten, Deputy Registrar I and Jolene Johnson, Assistant Historical Museum Director.  No Board action was taken.   

The Chairman asked if there were any additions to the agenda.  Several items were added.

It was moved by Robert Moline, seconded by Gerald Magnus, and passed to approve the agenda as modified.

It was moved by John Giese, seconded by William J. Sauer, and passed to approve the minutes of the July 1, 2008 meeting.

Heidi Winter presented the following petitions for repair: County Ditches 56 and 67.

A motion was made by Robert Moline, seconded by Gerald Magnus, and carried that the Commissioners appointed as Inspectors in and for the County of Murray, are hereby instructed to examine and inspect that portion of the foregoing described County and Judicial Ditches, lying within the County of Murray, for the purpose of determining what repairs are necessary, and if deemed necessary, to prepare either a cost estimate of said repair, or order said repairs to be made, with a report to be given thereon at a Murray County Board of Commissioner’s meeting, held in the Commissioners Room of the Murray County Government Center, Slayton, Minnesota.
                          
The individual Commissioners reported on their ditch inspections.

A motion was made by Gerald Magnus, seconded by John Giese, with all members of the Board voting their approval to accept the report of the Ditch Committee of the County and Judicial Ditches lying within the County of Murray on those petitions for repair that have been inspected for determining what repairs, if any, are necessary, the extent and nature of such repairs, an estimated costs of such repairs or a list of bills presented for payment that will enable said ditches to answer their purposes and to pay all bills contained within the report.

Heidi Winter presented an invoice for aerial spraying of open ditches performed on June 23, 2008.

Chief Deputy Randy Donahue met with the Board to discuss the citizen concern with golf carts and ATVs brought to the July 1, 2008 Open Forum.  He distributed copies of state statutes and ordinances from other Counties. 

It was moved by Robert Moline, seconded by William J. Sauer, and passed to instruct the County Attorney  to draft an ordinance for ATV and golf cart use on roads within the county, with the exception of state highways and all street and roads within incorporated cities, to be brought back to the County Board on July 15, 2008 for consideration.  

A quote was presented for six windows on the Presbyterian Church from Joe Schreier Construction, Inc. for $2,310.00. 

It was moved by John Giese, seconded by Gerald Magnus, and passed to award Joe Schreier Construction the quote for materials and labor to install six windows in the Presbyterian Church at End-O-Line Railroad Park and Museum for the quoted price of $2,310.00.

Chris Hansen met with the Board to request authorization for purchasing a computer and related software for the Water Resources Department.  A quote was presented from The Computer Man for $747.63 for a computer and $302.41 for Microsoft Office Small Business software.

It was moved by Robert Moline, seconded by William J. Sauer, and passed to authorize the purchase of a computer and related software from The Computer Man for $747.63 and $302.41, respectively, for the Water Resources department.

Commissioner John Giese gave a Building Committee update as follows:
• The Round Barn roof repair is underway with the annex portion to be completed before the Draft Horse Show on July 12-13, 2008. 
• The Grandstand fence project is complete.  The fence along the north side will not be permanently installed at this time to allow for possible future expansion. 
• The boiler in the Dinehart-Holt House is installed.  By consensus the Board directed the Building Committee to secure the outside entrance to the basement with a new door and install a false wall between the entrance and basement.  The Board also directed the Building Committee to obtain a quote to upgrade the patio installation to a stamped cobblestone concrete finish at the Dinehart-Holt House.  No Board action was taken. 

Howard Konkol, Soil and Water Conservation District, met with the Board to discuss the landscaping at the Industrial Park storage building.  Water running off the building is causing the soil around the perimeter to erode.  This could be remedied if rock rip-rapping were to be installed.  A quote was presented for rock, weed barrier and installation as follows:

It was moved by John Giese, seconded by William J. Sauer, and passed to authorize an expenditure, not to exceed $3,000, for 320’ of rock rip-rap landscaping around the IP Storage Building payable to The Rock Depot, with Murray County to invoice the Murray County Soil & Water Conservation District for half of the cost of the project.

Konkol also reported that the Southwest Minnesota Association of Conservation Districts Regional Environmental Fair will be hosted by Murray County on September 23-24, 2008 at the Murray County fairgrounds.  This is a regional fair that involves 1,800 – 2,000 sixth-grade students.  No Board action was taken. 

Commissioner John Giese reported that the USFWS will be hosting a friends group at Slaughter Slough on August 6, 2008.  He invited the Board to attend.  No Board action was taken. 

Commissioner John Giese also reported that a provision in the Racing Association Contract states that the County will be paid $1.00 for each attendee at the races, including free tickets, season passes, media and VIP passes.  This equates to approximately 100 tickets each race that the County has not been paid for.  This will be remedied in the future.  No Board action was taken. 

Commissioner Robert Moline brought up the portable stage needed at the grandstand for the County Fair talent show.  The Board directed Christy Riley to explore the size and availability of the stage that was rented from Currie Town & Country for the 150 year celebration in Currie. 

Commissioner Moline continued with a report from the July 7, 2008 Public Health meeting, stating that they were informed of a 10% cut in Medicare that is coming in the near future.  No Board action was taken. 

Open Forum / Public Comment:
• Jim Kluis met with the Board to discuss the lack of spectator space in the new grandstands.  He asked if there was additional seating that could be brought in for the Fair as well as the large special events that the MCRA is hosting during the season.  The Board informed him that they are exploring the costs and feasibility of adding one more section of bleachers onto the north end of the current structure if space continues to be a problem.  Kluis encouraged the Board Members to attend a race to witness for themselves the lack of space. 

The City of Slayton has requested that the Board Appoint Commissioner John Giese to the Slayton Airport Commission. 

It was moved by Gerald Magnus, seconded by William J. Sauer, and passed to appoint Commissioner John Giese to the Slayton Airport Commission for a one-year term to end 12/31/08.

John Giese and Christy Riley will be attending a Southern Minnesota Tourism Association meeting in Fairmont on July 16-17, 2008 and are requesting overnight stay approval for July 16th.

It was moved by Robert Moline, seconded by John Giese, and passed to approve overnight stays for John Giese and Christy Riley to attend the Southern Minnesota Tourism Association meeting on July 16-17, 2008 in Fairmont.

Heidi Winter reported that the Minnesota State Retirement System will be having a meeting on July 29, 2008 on the Health Care Savings Plan.  The Board will be discussing it with the Personnel Committee to appoint a delegate to attend. 

Commissioner Moline reported that he had a constituent request that the County look into hiring a part time ditch inspector rather than having the Commissioners as the Ditch Inspectors for their respective districts.  The Board directed Heidi Winter to look into this as part of the 2009 budget process.  No Board action was taken.  

Randy Groves met with the Board to open bids for the parking lot at the Human Services building.

Commissioner William J. Sauer asked if the east driveway on the Human Services lot could be left in place.  Groves reported that the east and west driveways will remain in tact but be narrowed and signed as a service entrance.  No Board action was taken.  

Groves tabulated the paving bids and reported that all bid amounts were correct. 

It was moved by William J. Sauer, seconded by John Giese, and passed to accept the low bid of $71,890.00 from McLaughlin & Schulz, Inc. for bituminous pavement for the Human Services Building parking lot.   

The Board discussed the installation of curb and gutter along the north side of the property.  Groves reported that the City of Slayton has a narrow strip of land along the north side of the property that they are interested in selling to the County.  The Board asked Groves to bring information on this acquisition back to the July 15, 2008 meeting for consideration.  No Board action was taken.

Christy Riley reported that the Casey Jones Trail ribbon cutting ceremony will be on July 10, 2008 in Pipestone and invited the Board to attend.

The Chairman recessed the meeting at 11:20 and reconvened at the Fairgrounds at 11:40 a.m. for a grandstand inspection.  The Board directed Heidi Winter to contact Steve Robinson for a timeline and approximate cost to install an additional segment of bleachers to be added to the north end of the current structure.  No Board action was taken. 

The Chairman recessed the meeting for lunch at 12:15 p.m.

The Chairman called a Public Hearing for the DNR Petition for Impoundment and Partial Abandonment of County Ditch 4 to order at 1:00 p.m.

Wendy Kruger, DNR Area Wildlife Supervisor, gave an overview of the Dovray WMA Water Level Management Plan and summarized the petition filed on April 28, 2008.  Kruger reported that upon further review the need for a partial abandonment was unnecessary and therefore withdrew that part of the petition.  She reported that the DNR is still petitioning for the impoundment in Section 19 of Dovray Township.  She then turned the program over to Douglas Lipetzky, Senior Regional Engineer for Ducks Unlimited, to give the Engineering Report. 

At 1:35 p.m. the Chairman took public comment from the audience. 

At 2:15 p.m. the Chairman closed the public comment portion of the hearing for the DNR Petition for Impoundment and Partial Abandonment of County Ditch 4.

It was moved by John Giese, seconded by Gerald Magnus, and passed to approve the water impoundment project to install a weir in section 19 of Dovray Township and to approve the Dovray WMA Water Level Management Plan as presented. 

It was moved by Gerald Magnus, seconded by Robert Moline, and passed to deny the Abandonment Portion of the DNR Petition for Impoundment and Partial Abandonment of County Ditch 4 filed on April 28, 2008. 

County Attorney, Paul Malone will draft the findings and order for the petition and report back to the Board. 

The Chairman reconvened the regular meeting at 2:23 p.m.

The meeting adjourned at 2:30 p.m.
