PROCEEDINGS OF THE MURRAY COUNTY BOARD OF COMMISSIONERS
MURRAY COUNTY GOVERNMENT CENTER – SLAYTON, MINNESOTA
June 9, 2009 – 8:00 a.m.
Pursuant to notice, the Murray County Board of Commissioners convened with the following members present: Commissioners Gerald Magnus, Robert Moline, William J. Sauer and Kevin Vickerman. Commissioner John Giese had an excused absence. Also present Heidi Winter, Auditor-Treasurer and Paul Malone, County Attorney.
The meeting opened by reciting the Pledge of Allegiance to the Flag.
The Chairman asked if there were any additions to the agenda. Several items were added.
It was moved by William J. Sauer, seconded by Kevin Vickerman, and passed to approve the agenda as modified. It was moved by Robert Moline, seconded by William J. Sauer, and passed to approve the minutes of the June 2, 2009 meeting.
Heidi Winter presented the following petitions for repair: Judicial Ditch 10.
A motion was made by Kevin Vickerman, seconded by William J. Sauer and carried that the Commissioners appointed as Inspectors in and for the County of Murray, are hereby instructed to examine and inspect that portion of the foregoing described County and Judicial Ditches, lying within the County of Murray, for the purpose of determining what repairs are necessary, and if deemed necessary, to prepare either a cost estimate of said repair, or order said repairs to be made, with a report to be given thereon at a Murray County Board of Commissioner’s meeting, held in the Commissioners Room of the Murray County Government Center, Slayton, Minnesota.
The individual Commissioners reported on their ditch inspections.
A motion was made by Robert Moline, seconded by William J. Sauer, with all members of the Board voting their approval to accept the report of the Ditch Committee of the County and Judicial Ditches lying within the County of Murray on those petitions for repair that have been inspected for determining what repairs, if any, are necessary, the extent and nature of such repairs, an estimated costs of such repairs or a list of bills presented for payment that will enable said ditches to answer their purposes and to pay all bills contained within the report.

Heidi Winter presented a quote from Teryjon Aviation, Inc for $33.55 per acre to spray the open ditches in Murray County.
It was moved by William J. Sauer, seconded by Kevin Vickerman and passed to hire Teryjon Aviation, Inc. to spray the open ditches in Murray County as quoted for $33.55 per acre and to authorize the Board Chair to sign the spraying agreement as presented.
The Board discussed a survey sent out by the AMC District 8 Planning Group. The survey was sent to all Counties in AMC District 8, asking the Board to respond either yes or no on whether they wish to continue the planning meetings and if they want to hire an outside facilitator to aid in the planning.
It was moved by Kevin Vickerman, seconded by William J. Sauer and passed to support continuing the AMC District 8 Planning Meetings.
It was moved by William J. Sauer, seconded by Kevin Vickerman and passed to continue the AMC District 8 Planning Meetings without the assistance of an outside facilitator at this time. Commissioner Robert Moline abstained.
The Board was presented with a $1,500 donation from the Lake Shetek Walleye Tournament.
It was moved by William J. Sauer, seconded by Robert Moline and passed to accept a $1,500 donation from the Lake Shetek Walleye Tournament to be used to defray the costs of the grinder at the Marsh’s Landing Fish Cleaning Station.
It was moved by Robert Moline, seconded by William J. Sauer and passed to authorize the Board chair to sign a thank you letter to the Carl & Verla Schmidt Foundation for a $10,000 donation to the Historical Society for the Dinehart-Holt House roof.
Jean Christoffels presented a letter of resignation from Wendy Haney, resigning her position on the Murray County Board of Adjustments. Haney has served in this capacity for five years.
It was moved by Kevin Vickerman, seconded by William J. Sauer and passed to accept, with regret, the resignation of Wendy Haney from the Murray County Board of Adjustment for her term ending December 31, 2009. It was moved by Robert Moline, seconded by William J. Sauer and passed to appoint Darwin Patzlaff to the Murray County Board of Adjustments to fill out a term ending December 31, 2009.
Commissioners Robert Moline, William J. Sauer, John Giese and Gerald Magnus will be attending the July 9, 2009 Southwest Regional Development Commission Annual Meeting and Banquet at the Key Largo Ballroom.
Katie Meyer presented the following items as recommendations from the Personnel Committee.
It was moved by William J. Sauer, seconded by Kevin Vickerman and passed to approve changing the effective start date of the Highway Department Seasonal Weed Sprayers Thomas Noerenberg & LeRoy Johnson from June 3, 2009 to June 2, 2009.
Heidi Winter presented a draft Wellhead Protection Program Plan from the City of Balaton for review and comment. She informed the Board that comments will be accepted by the city until August 7, 2009 and will be addressed at the public hearing set for August 10, 2009 at 6:30 p.m. at the Balaton Community Center. The draft plan will be kept in the Commissioner’s Room for review by the Board. No Board action was taken.
Commissioner Vickerman reported on the June 4, 2009 Fairgrounds Advisory Committee Meeting.
He reported that the Murray County Draft Horse Committee has volunteered to provide materials and labor to brace and bolt the stalls and roof of Sheep Barn on the Fairgrounds. This project would come at no cost to the County.
It was moved by Robert Moline, seconded by William J. Sauer and passed to authorize the Murray County Draft Horse Committee to provide materials and labor to brace and bolt the stalls and roof on the east side of the Sheep Barn on the Fairgrounds, with Murray County bearing no expense for the project.
Vickerman was joined by Mike Bambrick to further update the Board on the reinforcement of the Horticulture Building Roof.
It was moved by Robert Moline, seconded by Kevin Vickerman and passed to authorize that two ads be placed with the Murray County Editorial Group requesting quotes for labor only for the following repairs on the Fairgrounds Horticulture Building:
- To plumb walls, remove swayback and reinforce the roof structure.
- To over lay the roof with steel.
Quotes will be opened and considered on July 7, 2009 at 10:15 a.m. and 10:20 a.m., respectively. Materials will be provided by Murray County.
Chair Magnus reported on the June 8, 2009 Shetek Area Water and Sewer District Meeting. No Board action was taken.
Heidi Winter presented a one day 3.2 Malt Liquor On Sale License (License Number 11) to the MN Xtreme Bull Riding Tour LLC.

OPEN FORUM – PUBLIC COMMENT:
- Tom Norenberg, representing the Currie American Legion, requested permission to put an aluminum can recycling bin next to the County’s recycling shed in Currie. It would be a fund raising effort to help offset the cost of the annual fire works display. The Board reported that they would address the request when they went out of Open Forum.
- Dale Vos on behalf of Case Vos met with the Board to express concerns that spoils were placed on their CRP property after a ditch clean out. This action put Mr. Vos in violation of his CRP contract and at risk of fines. Paul Malone reported that he and Commissioner Robert Moline would be attending the June 23, 2009 CRP hearing on the matter, with the permission of Mr. Vos. The process by which ditch contractors handle these situations in the future will be reviewed.
Matt Surprenant and Jim Reinert of the Shetek Township Board met to discuss funding for the Bloody Run Bridge in Shetek Township. They asked the Board if they would consider being a financial partner in the project to help with the costs of going from a 9’ to a 10’ culvert. The estimated cost to the County would be $10,000. Commissioner Kevin Vickerman suggested approaching the Murray County Economic Development Authority for part of the funding. The Board asked that they present a formal request in writing and will address the request at that time. No Board action was taken.
Stacy Posthuma of the 4-H Horse Committee, met with the Board to discuss a project to build an Announcer’s Booth and Storage Shed near the Horse Arena on the Fairgrounds. She presented a set of plans drawn up by Jens Construction, requesting that the Board approve the plans and project and consider partnering with a cash match for a Minnesota Horse Council Grant Application. The Board asked Posthuma to call Jens Construction and check on pricing to purchase the set of plans. The Board continued with other business while the call was being made.
It was moved by Robert Moline, seconded by William J. Sauer and passed to authorize the Currie Legion to place an aluminum can recycling bin next to the County Recycling Shed in the City of Currie, contingent upon authorization from Jon Bloemendaal.
Chair Magnus reminded the Board to attend the Hospital Community Appreciation Picnic on June 10, 2009. Stacy Posthuma returned to the meeting after talking with Jens Construction. She reported that the cost of the plans for the 4-H Horse Arena Announcer’s Booth/Storage Shed is $100.
It was moved by Robert Moline, seconded by Kevin Vickerman and passed to authorize an expenditure of $100 to Jens Construction to purchase a set of plans for the 4-H Horse Arena Announcers Booth/Storage Shed.It was moved by Kevin Vickerman, seconded by William J. Sauer and passed to authorize that an ad be placed with the Murray County Editorial Group requesting quotes for labor only to construct an Announcer’s Booth/Storage Shed near the horse arena on the Fairgrounds, to be opened and considered on July 7, 2009 at 10:25 a.m. Materials will be provided by Murray County.
It was moved by Kevin Vickerman, seconded by William J. Sauer and passed to approve a 4-H project and plans for an Announcer’s Booth/Storage Shed to be constructed near the Horse Arena on the Fairgrounds, further approving a $6,000 grant match for a Minnesota Horse Council Grant.
There being no further business meeting adjourned at 11:09 a.m.
