PROCEEDINGS OF THE MURRAY COUNTY BOARD OF COMMISSIONERS
MURRAY COUNTY GOVERNMENT CENTER SLAYTON, MINNESOTA
JULY 19, 2005 10:30 A.M.

Pursuant to notice, the Murray County Board of Commissioners convened in special session with the following members present:  Commissioners Alfred Gertsema, Robert Moline, Lyle Onken, William J. Sauer and Kevin Vickerman.  Also present Gary D. Spaeth, Auditor/Treasurer and Paul Malone, County Attorney.

Randy Groves met with the Board to open bids for Chanarambie Township Bridge SAP 51-599-86, as follows:

Randy will take the bids back to his office for tabulation.

Randy gave an update on construction projects and asked the Board to set a deadline for a culvert to be replaced on CSAH 13 by the landowner.

It was moved by Robert Moline, seconded by Kevin Vickerman, and passed to set a deadline of August 2, 2005 for a landowner to have replaced a culvert on CSAH 13.

It was moved by William Sauer, seconded by Kevin Vickerman, and passed to appoint Tom Wenzel, PE, as the Project Engineer for petitions for abandonment and impoundment on County Ditch 65.

It was moved by Lyle Onken, seconded by Robert Moline, and passed to set a Preliminary Hearing for Impoundment and Abandonment on County Ditch 65 for August 16, 2005 at 1:00 p.m.

It was moved by Kevin Vickerman, seconded by Lyle Onken, and passed to change the August 9 Ditch and August 16 regular meetings of the Murray County Board to August 16 and August 23, 2005, respectively.

It was moved by Lyle Onken, seconded by William Sauer, and passed to authorize the transfer of a 2005 Tobacco License from Easy Street to Cenex Convenience Store.

Jim Johnson met with the Board to request permission to pursue a contract to have microfilm card images transferred to Compact Disk (CD) for $.12/image.  The estimated cost would be $22,000-23,000 to complete and would also require the purchase of software at a cost of $3,000.

It was moved by William Sauer, seconded by Lyle Onken, and passed to authorize the Recorder to proceed to contract for services of transferring microfilm card images to CD and to purchase the required application software.

Jim distributed the results a survey of counties of elected official benefits after retirement.  The issue will be re-addressed at the end of 2005.  No action was taken.

It was moved by Lyle Onken, seconded by William Sauer, and passed to award the contract for SAP 51-599-86 to Mathiowetz Construction Company for the low bid of $90,558.00.

Kevin Vickerman reported several issues that came up at the Shetek Area Water and Sewer Commission (SAWSC) meeting on Monday.  Bonestroo and Associates has requested a disclaimer agreement before it would release electronic data from its design of gravity and vacuum sewer collection systems.  Paul Malone requested information from the meeting when the Board agreed this to so he can prepare the requested agreement.  

Kevin informed the Board that it should attend the July 25, 2005 SAWSC meeting to participate in a preview by Bolton & Menk of the presentation to be made at the July 30th Improvement hearing.  The Board clarified that its Chair would preside at the Hearing.  Kevin indicated that the Board should decide when it would take action on the pressurized sewer improvement.  Bolton & Menk prefers that action be taken at a subsequent meeting of the Board.  The item will be placed on the agenda for the July 26, 2005 meeting.

The Board reviewed information contained in the Board packets from MCIT regarding the removal of two members of the SAWSC on December 28, 2004 and their subsequent appearances before the Board on July 5, 2005.  No action was taken.

Robert Moline brought up that his constituents want to know when the Zoning Ordinance would be adopted.  The Board will have the Environmental Office inquire of the DNR if it would approve the Ordinance if the impervious surface language regarding gravel were removed.  The Board will revisit the issue following a response back from the DNR so that the new ordinance can be published and put into effect.

William Sauer reported that the City of Avoca could supply a water hook-up to Lime Lake County Park for a $250 hook-up fee, plus monthly charges for water of $22 plus $2.50 per 1,000 gallons.  Bill would bring the information to the Parks Board.  No action was taken.
